Terms of Service
Republic of the Philippines
By accessing or using Sadaqah PH (the "App") and its related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the App or Services.
1. Acceptance of Terms
- These Terms govern your access to and use of the Sadaqah PH website, mobile application, and any related services.
- We may update these Terms from time to time. The updated version will be posted on the App with a new effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.
- If any term is found unenforceable, the remaining terms will remain in full force and effect.
2. Eligibility
- You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.
- By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement and to make donations in accordance with these Terms.
- If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Description of Services
- Sadaqah PH is a platform that enables users to make voluntary charitable donations to campaigns, causes, and beneficiaries listed on the App.
- We act as a facilitator and technology provider. We are not necessarily the ultimate recipient of all donations; some campaigns may be operated by third parties (individuals, groups, or organizations).
- We do not guarantee the outcome of any campaign, the use of funds by beneficiaries, or any specific result from your donation.
4. User Accounts and Security
To use certain features (e.g., making donations, managing campaigns), you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials;
- All activities that occur under your account; and
- Notifying us immediately of any unauthorized use or security breach.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
5. Donations and Payments
All donations made through the App are voluntary and non-refundable, except as required by law or as expressly stated in these Terms. By making a donation, you confirm that:
- The funds are lawfully yours to donate;
- You are not donating on behalf of or using funds linked to illegal activities, terrorism, money laundering, or sanctions violations; and
- You understand that some administrative or processing fees may apply (if disclosed at checkout).
Payments are processed via third-party payment processors (e.g., PayMongo). Their terms and privacy policies also apply to payment transactions. We do not store full credit/debit card numbers or CVV codes — payment data is handled in accordance with our Privacy Policy. We may refuse, cancel, or suspend any donation or campaign if we suspect fraud, violation of law, or breach of these Terms.
6. Campaigns and Beneficiaries
Campaign creators (if applicable) are responsible for:
- Providing accurate, complete, and non-misleading information;
- Using donations only for the stated purpose; and
- Complying with all applicable laws, including Philippine laws on fundraising, taxation, and anti–money laundering.
We may review, modify, or remove campaigns at our discretion, especially if they appear to violate these Terms, are misleading, or pose legal or reputational risk. We do not endorse or guarantee any campaign, beneficiary, or outcome. Your decision to donate is at your own risk.
7. Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose or in violation of any local, national, or international law.
- Engage in fraud, misrepresentation, money laundering, or terrorist financing.
- Upload or transmit malicious code, viruses, or anything designed to interfere with the App's functionality.
- Harass, abuse, or harm another person, or promote hate, discrimination, or violence.
- Impersonate any person or entity, or falsely claim affiliation with any organization.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Use automated systems (bots, scrapers) to access the App without our prior written consent.
8. Intellectual Property
- All content on the App (including text, logos, graphics, code, and design) is owned by or licensed to Ahmad Yaqeen Mohamad, unless otherwise stated.
- You may not copy, reproduce, distribute, modify, or create derivative works from the App's content without our prior written permission, except as allowed by law.
- If you submit content (e.g., messages, testimonials, campaign descriptions), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Services.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:
- The Services will be uninterrupted, secure, or error-free;
- Defects will be corrected; or
- The App or its servers are free of viruses or harmful components.
We do not guarantee that donations will achieve any particular social or charitable outcome.
10. Limitation of Liability
- To the maximum extent permitted by law, Ahmad Yaqeen Mohamad shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.
- Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount of donations you have made through the App in the six (6) months preceding the claim, or PHP 5,000, whichever is lower, unless otherwise required by law.
- Nothing in these Terms excludes liability for gross negligence, willful misconduct, or fraud.
11. Indemnification
You agree to indemnify, defend, and hold harmless Ahmad Yaqeen Mohamad, and our officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of:
- Your use of the Services;
- Your violation of these Terms; or
- Your violation of any rights of another person or entity.
12. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of laws principles.
- Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation.
- If not resolved amicably, the dispute shall be submitted to the appropriate courts of the Philippines, unless mandatory law provides otherwise.
13. Suspension and Termination
- We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, as permitted by law.
- Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination (e.g., disclaimers, limitation of liability, governing law) shall survive.
